		<description>Agreed, Steve. Unfortunately I have been too busy to go up to Superior Court in Boston. I've relied on Tekmira posting court proceedings for their lawsuit against Alnylam and Alcana. There's been nothing new since July. I'll be in San Diego and LA Monday thru Friday so I won't be able to get back to this until next weekend. I will check PACER later.</description>

I'll be interested to have a look at that patent app. Keep in mind though that patent applications (as opposed to actual granted patents) tend to claim everything under the sun (here: from medicine to agriculture).  Also worth mentioning is that the Monsanto-Devgen Western Corn Rootworm paper where sprayable RNAi pesticides were (to my knowledge) first published was published in 2007 in Nature Biotech.  As the payment to ISIS indicates, my guess is that an important part of the license is the oligo-related patent estate by the 2 companies.
